$1M Fines for Social Media Amplifying Hateful Content
California’s legislature has advanced Senate Bill 771 and it’s heading to Governor Newsom’s desk.  The measure is aimed at holding social media platforms accountable for the algorithmic amplification of “hateful content.”  Read more here.  Query: this may sound good, but there are plenty of people in California who think conservative speech is ‘hateful’.  Will this law be used to censor conservatives?

Supreme Court to open term hearing case over what lawyers may discuss with testifying clients
The Supreme Court will begin its 2025-26 term with the justices hearing a case over whether blocking a lawyer from speaking with his client about that client’s testimony during overnight recess of the court is unconstitutional.  Read more here.

The National Marine Fisheries Service Violated the Appointments Clause of the U.S. Constitution
The New England Fishermen’s Stewardship Association (NEFSA) challenged the constitutionality of U.S. fishery management councils in September 2023 in a lawsuit against the U.S. government and the National Marine Fisheries Service (NMFS). NEFSA claimed the appointment process for council members was unconstitutional and violated the Appointments Clause of the U.S. Constitution as it allowed undemocratically elected members of the council to make decisions.  A U.S. District Court has ruled in favor of the NEFSA.  Read the story here.

Supreme Court takes up Clean Air Act and sentencing cases
The justices added four new cases, involving the venue for challenges to the Environmental Protection Agency’s actions under the Clean Air Act and federal sentencing law, to its docket for the 2024-25 term. Illegal aliens could swing the 2024 election

The First Amendment protects speech from government censorship. But what about free speech on social media? Social media platforms are private companies and are not bound by the First Amendment. In fact, they have their own First Amendment rights. This means they can moderate the content people post on their websites without violating those users’ First Amendment rights. It also means that the government cannot tell social media sites how to moderate content. Many state laws to regulate how social media companies can moderate content have failed on First Amendment grounds.  Read more here.

• Important Exception - Social media platforms can become First Amendment space if they act as agents of the government and censor information as the government directs.  This is called the ‘state actor’ doctrine.  Unfortunately, the Supreme Court turned away a challenge this year on technical grounds from two state attorneys’ general and other plaintiffs who demonstrated that 80 federal government agencies coordinated with Facebook, Twitter, and other social media platforms to censor the Hunter Biden laptop story, the disturbing truth about COVID vaccines, and other truthful information the American people were entitled to have.  It is a clear and continuing case of social media platforms who have become ‘state actors’ to do the government’s censorship dirty work the government knows it could not do itself under the First Amendment.

Supreme Court Rules In Favor Of Injunctions Blocking Biden’s Pro-transgender Title IX Rewrite
The new “Biden Rule,” released in April, added gender identity to Title IX, thus allowing female-identifying men into women’s bathrooms and requiring others to address them with their preferred pronouns — alongside other provisions unrelated to transgender issues.  The SCOTUS ruled unanimously in favor of the injunctions in 10 states blocking the new rule.  Read more here.

U.S. Appeals Court Rules Geofence Warrants Are Unconstitutional
A federal appeals court has ruled that geofence warrants are unconstitutional, a decision that will limit the use of the controversial search warrants across several U.S. states.  It found that geofence warrants are “categorically prohibited by the Fourth Amendment,” which protects against unwarranted searches and seizures.  Read more here.

• Our southern border remains open and vulnerable and the federal government is enabling the illegal crossing of people from all over the world, including by our adversaries.  Illegal dangerous drugs are being trafficked through that open border by criminal gangs.  Many of these illegal crossers have been apprehended or arrested for crimes committed once they are inside the U.S.  Some have been deported just to boomerang back again over the porous border.  Without border security, we are a nation in peril.
